'Following Demon's experience in 1999, the company has felt enormous pressure to remove sites when complaints are made. At the same time, we do not believe that we, or other ISPs, are able to deal fairly with these cases as ISPs are neither qualified nor resourced to decide on the legality of material online, nor are they authorised to do so. Ultimately, it is up to a court of law to decide whether material is defamatory, not an ISP.
A PDF of the report can be downloaded at the Law Commission Web site.
