Apple sued over iPods damaging hearing

A Louisiana man has filed a lawsuit against Apple alleging that his iPod damaged his hearing.
John Kiel Patterson claims that iPods are 'inherently defective in design and are not sufficiently adorned with adequate warnings regarding the likelihood of hearing loss'. He is seeking damages and wants the court to force Apple to make changes to make iPods 'safer'.
iPods can produce sound up to 115 decibels which, the lawsuit alleges, can damage hearing after just 28 seconds exposure per day.
Apple declined to comment, but does include a warning with all iPods that high volume use may damage hearing.
In Europe, iPod volume is restricted by EU regulations.
