Now Apple sends Samsung Galaxy Tab 7.7 into hiding

Samsung has stopped promoting its new tablet computer at Europe's biggest consumer electronics fair, after a court-ordered sales injunction in Germany.
In the latest setback in its ongoing legal battle with iPad maker Apple, a Dusseldorf court ordered Samsung to stop selling the Galaxy Tab 7.7 at the annual IFA electronics show in Berlin.
The move follows an earlier temporary ban on German sales of Samsung's Galaxy Tab 10.1, with a final ruling scheduled for the end of this week.
The Tab 7.7 is the latest addition to Samsung's range of Galaxy products. It was first unveiled at the show along with the 5.3in Galaxy Note smartphone, which Samsung hopes will create a new product category and fill the gap between smartphones and tablets.
"The product is not on sale yet but we've decided to respect the court order," Samsung spokesman James Chung said.
First-look review
Find out what we're missing out on with our first-look review of the Samsung Galaxy Tab 7.7 hereSamsung and Apple have been locked in an acrimonious battle over smartphones and tablets patents since April, as Apple seeks to rein in the growth of Google's Android phones and tablets by taking direct aim at the operating system's biggest vendor, Samsung.
Apple has argued that Samsung had infringed on its patents and the Galaxy line of smartphones and tablets "slavishly" copied its design, look and feel. It is fighting legal battles in the US as well as Europe, South Korea and Australia.
The battle forced Samsung to delay its tablet sales in Australia twice, while Samsung has counter-sued, arguing Apple infringed its wireless patents.

Apple is the new Microsoft
Didn't see that coming did ya, fan boi.

Not so 'smooth'..
Well, we now know what Samsung calls 'smooth' sales (google "tab shipped vs sold")..
I guess now we also know what they'd consider not so 'smooth'..
Maybe Samsung need to take some advice from Sony, Dell, Acer, HTC etc. on how not to copy Apple. They seem to be doing ok.

So easy...
to confuse a 7.7" Galaxy Tab with the iPad 7.7"...
Oh, wait, Jobs said that nobody would ever want a sub 10" tablet, so I don't see where the confusion could come in... :-S

No patents...
In Germany, it is purely "look and feel", no patents were involved.
Apple claimed, simply, that the Galaxy Tab infringes the look and feel of the iPad (LCD screen, in a black frame in a tablet shaped case, with rounded corners and the home screen (when man customises it and deletes the default widgets) can look like an iPad - especiall when man retouches the image to remove the Samsung logo and give it a 4:3 aspect ratio, instead of its actual 16:9 aspect ration).

Only in Germany
@ihsan, Apple have only succeeded so far in Germany; the Dutch court, in particular, rejected the community design copying argument and only upheld 1 minor patent about "bouncing" photos. The reason Apple is targeting Samsung (IMHO) is not because of "slavish copying" but because Samsung are the most successful of the Android vendors and thus represent their greatest threat. You can be sure that if Apple succeed against Samsung they will then go after other vendors.

Apple are spooked....
The Galaxy-S2 has scared them senseless as it's replaced the iphone as the 'must have' phone (they are popping up everywhere - including in my pocket!). Sorry Apple, you've been outdone now it's sour grapes.

Suing your major component supplier
Way to drum up major product shortage later on Apple.
What if Samsung develop a new chip you want for your new iPod/Phone/Pad and they wont sell to you?
Short term corporate greed thinking.
Alas poor Steve, Apple sinks from innovation to litigation and the core begins to go rotten at Apple.
By cheysuli on 5 Sep 2011 ![]()
Not beyond a reasonable doubt..
@milliganp - "only succeeded so far in Germany"
The fact that it's suceeded at all in any country (or even granted preliminary injuctions in others) goes to show that it's not at all unreasonable to claim that they look alike..
The more I you look at what the other competitors are doing, the more examples you get of how not to copy. Like I said, look at Sony's tablets or Dells, or HTC's.. None of those would have been confused for iPads, particularly when you have them hand in hand (and not just based on images..).
IMHO, I think Apple just want to make an example of Samsung. If you copy our look and feel, we will go after you..
If Apple suddenly decide to sue Sony for violating trade dress, them maybe you've got a point.
On an unrelated matter, I can't help be drawn to Samsung's new Series 7 alu laptops. They're unlike anything I've ever seen before. Beautiful..
By ihsan on 5 Sep 2011 ![]()
@ihsan
This is a preliminary injuction, in Germany.
Apple turned up at the court, asked the judge to ban the products, until the case could be reviewed...
Samsung can only defend themselves, once the case comes to court, in the mean time, they have to stop selling their products here.
I'm hoping that Apple fall flat on their faces. I used to like Apple, but what they are currently doing leaves a bad taste in my mouth.
By big_D on 5 Sep 2011 ![]()
Still not beyond a reasonable doubt..
@big_D - "This is a preliminary injuction, in Germany."
Aren't preliminary injuctions only granted if there was at least some credibility to the claim?
So you can without a doubt claim that some of Samsung's products don't look even a bit like Apple's?
You know what leaves a bad taste in my mouth? Google this - "android before and after the iphone".
By ihsan on 5 Sep 2011 ![]()
Oh the irony.....
Google this - "android before and after the iphone". (Google search!)
What an utter load of tosh - the 'before' shot is android running on a completely different form factor (with no touchscreen by the look of it). The second has Sense UI - firstly, not Google's or Samsung's handywork, secondly, not in anyway like the iPhone (how many iphones have you seen with a SenseUI like interface??).
If you really want to talk about copying - I had numerous touchscreen Windows Mobile phones before the iPhone ever existed - could MS claim Apple stole their idea? Just as ludicrous as Apple's claims vs Samsung.
By everton2004 on 5 Sep 2011 ![]()
Google do a great search..
@everton2004 - I don't see the irony.. I'm not going to deny/pretend that google don't do a decent search engine.. They did a good job there..
What I won't skirt around is how before the iPhone, Androids mimicked the (then) market leading Blackberry.. Running on a completely different form factor you say? That was the ONLY form factor they'd ever originally intended.
There was no capacitive multitouch screen, there was no keyboardless design, there was no pinch & zoom on a phone. None of that existed on a phone until the iPhone.. You know how the android interface graphics subsystem is as smooth as treacle? That's cause the software was never designed to stretch so far as to animate sliding panels and other fluid animations.. It's a remnant of an under-specced OS originally intended to work like a BlackBerry.. It's only now with Honeycomb that they've managed to build it a decent interface graphics subsystem based on true 3d objects instead of bitmapped images..(like on the iPhone)
But getting back to the point, so am I right to say that you won't even remotely entertain the notion that some of Samsung's products look a bit like Apple's?
Btw, I've owned a fair few winCE HP Jornadas, a handful of palms.. Not one of them even remotely reminds me of an iPhone.. Want to know what Samsung's phones looked like before the iPhone? Google that too.
By ihsan on 5 Sep 2011 ![]()
Whoops..
Just for clarity, I meant to say there was no keyboardless design for an Android phone before the iPhone..
By ihsan on 5 Sep 2011 ![]()
Rotten Apple?
The worm has finally crawled out of the Apple showing its true form as a spoiler of competitive development. Dictators fall through their restrictive practices and lose support. Clearly, the patent laws are a mockery and need reform to stop the Apples of this world trying to tie up any idea that has not come from them.

German Court
Evidently the German Courts are quite happy with the cash apple is pouring into their system - like in American, you can always buy as much justice as your bank account allows you to.

Hearing from you really cheers me up. Now all we need is for your buddy swissmac to chime in and we can have a fanboi chorus.

Copyright confusion
@ihsan A Sony TV bears a striking resemblance to a Toshiba TV which is remarkably similar to an LG TV. It doesn't mean that there's an infringement going on.
This is pathetic behaviour from Apple & it removes that last lingering thought I had of buying an iPad, no matter how shiny they are!

@jontym123 "Hearing from you really cheers me up. Now all we need is for your buddy swissmac to chime in and we can have a fanboi chorus."

"Translation: I have no valid counter argument to make so I'm just going to go ahead and call you a fanboi."
Wrong.
The correct translation is:
"You fanbois are so animal stupid that it's actually funny reading your twaddle."

Fan of which club?
@qpw3141
Translation: I still haven't got anything of substance to counter with so I'm just call you stupid.
BTW, which club am I supposed to be a fan of again? I like Apple phones, Google search engines and maps, samsung tv's, MS/Sony/Nintedo game consoles..

Oh wait, I remember you.. You're the person that said Mac OS would NEVER respond to the Malware 'crisis' and leave their users to drown under a storm of Malware some months back. Well spotted.

Now... I like qpw3141
on the other hand I also like ihsan.
but which one's better?
There's only one way to find out.
FIGHT!

What?
ihsan: "Oh wait, I remember you.. You're the person that said Mac OS would NEVER respond to the Malware 'crisis' and leave their users to drown under a storm of Malware some months back."
Where did I say that?
Link please.
It seems extremely unlikely that I said that as malware attacks on apple stuff are building and I don't believe that apple are incompetent and would do nothing about it as that would kill off the non-fanboi market for their goods. It might even, eventually, dissuade some of the less obsessive fanbois from purchasing their products.

@qpw3141
Oh? Not you? My mistake. I get mixed up with you guys sometimes..
Are you the 'apple are all marketing' person or the 'has no substanse so counters every argument by calling them stupid obsessed fanbois' person?
By ihsan on 6 Sep 2011 ![]()
@ ihsan
....actually, the reason behind the comment regarding swissmac is the same for all Apple fanbois. Fanbois make factual claims without a shred of credible evidence and refuse to see the error of their ways. If you and swissmac are stupid enough to worship at the apple alter then that's your choice. People with a mind of their own will shop elsewhere.
By everton2004 on 6 Sep 2011 ![]()
Ah, that kind of person it is then..
@everton2004
I might be wrong but usually, the way it works is that people have to actually be shown the error of their ways before they can refuse.
That's usually done through presenting some form of well reasoned argument. Perhaps even by providing evidence that disproves some of the claims made.
That probably usually works a bit better than the slightly different tact of just calling people 'animal stupid'..
By ihsan on 6 Sep 2011 ![]()
@everton2004
Oh sorry, I just mixed you guys up again. I wrongly attributed the 'animal stupid' quote to you.. Should have just attributed the 'stupid' to you..
By ihsan on 6 Sep 2011 ![]()
@ihsan
I thought I had, please take the time to read my earlier post before resorting to cheap shots. Perhaps if you take your apple tinted specs off you might see sense. Stupid? Me? Am I the one gifting my hardearned to uncle Steve? Nope. You're an apple fanboy, plain and simple.
By everton2004 on 7 Sep 2011 ![]()
@everton2004
I thing you've misunderstood my words. I wouldn't be so crass (or so rude) as to call someone stupid. But you're welcome to interpret my words however you see fit..
Anyway, you're entitled to your own opinion. Just a tip though, repeating something ad nauseum, doesn't automatically make it true.
