Nokia wins Qualcomm patent battle

Nokia has won the first of its patent battles with chip maker Qualcomm, though the ruling must still be verified by the International Trade Commission (ITC).

The complaint, which was filed in June 2006, accused Nokia of infringing on three patents covering technology which regulates power in mobile telephones.

"The administrative law judge, after a review of the record developed, finds inter alia that there is jurisdiction and that there is no violation," writes Paul Luckern, the administrative law judge who heard the case.

Qualcomm had asked the US ITC to bar the importation of the infringing technology, and the body must now decide if it will uphold Luckern's decision.

Nokia applauded the judge's initial determination, and claims the decision bodes well for the dozen other legal fights between the two companies which are being fought across three continents. Their expensive legal battle is worrying investors and the industry on both sides of the Atlantic.

In June, the ITC ruled that Qualcomm infringed a Broadcom Corp patent and banned imports of some new advanced cell phones using Qualcomm's chips.
