In order to lever OS X onto its PC hardware, the company employs PC EFI, a third-party software patch that enables non-Apple hardware to run the Mac OS. But it is doing so in breach of the PC EFI licence, according to its author, Netkas.

According to the licence, "Redistribution and use in binary form for direct or indirect commercial purposes, with or without modification, is stricktly [sic] forbidden."
Psystar has declined to comment further on the foofaraw surrounding the launch of its $399 Open Computer and is proving difficult to track down, though it does seem to have had time to move offices this week.
Apple has yet to make its move.
